This Distance Sales Agreement is concluded between the BUYER and the SELLER in accordance with Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, subject to the terms and conditions set out below.
Buyer information is the information declared in the order form. The BUYER is responsible for the accuracy of this information.
The subject matter of this agreement is the sale and performance of the digital service (SaaS - Software as a Service), with the characteristics specified herein, ordered electronically by the BUYER from www.zenwapp.com owned by the SELLER, and the determination of the parties’ rights and obligations under Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
5.1 The BUYER has the right to withdraw from the agreement within fourteen (14) days without giving any reason and without paying any penalty.
5.2 The withdrawal period starts on the date the service performance begins.
Cases Where the Right of Withdrawal Cannot Be Exercised:
Under Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for services performed instantly in electronic form or for intangible goods delivered instantly to the consumer, if the performance of the service has started with the consumer's approval. For digital SaaS services, service performance is deemed to begin once the account is opened and platform access is provided.
5.3 The BUYER wishing to exercise the right of withdrawal must notify the decision in writing to [email protected].
5.4 If the right of withdrawal is exercised, the amount paid will be refunded to the BUYER within fourteen (14) days from the date the withdrawal notice reaches the SELLER.
6.1 Before approving this agreement electronically, the BUYER has read and been informed about the preliminary information form regarding the service subject to the agreement.
6.2 The SELLER cannot be held responsible for delays or failure in performance caused by force majeure or internet, infrastructure, and communication problems.
6.3 This agreement enters into force on the date it is approved electronically by the BUYER.
6.4 In disputes arising from this agreement, Consumer Arbitration Committees are authorized up to the amount announced by the Ministry of Trade, and Consumer Courts are authorized for disputes above that amount.
Istanbul (Anatolian Side) Consumer Courts and Enforcement Offices are authorized for the resolution of any dispute arising from the implementation of this agreement.
This agreement consists of 8 (eight) articles and has entered into force upon electronic approval by the BUYER. The BUYER declares that all terms have been read, understood, and accepted.
